Probate Proceedings
A Probate Proceeding happens when a Person dies and leaves behind assets that have to be distributed to the heirs that were left behind and does not have a Living Trust or did not put some or all of their assets in the name of their Living Trust if they had one. If a Person dies and leaves behind a Will, the Executor named in the Will starts the Probate Proceedings by filing the appropriate Court paperwork. If a Person dies and did not have a Will when they died, then a friend or family member of the deceased must start the Probate Proceedings by filing the appropriate Court paperwork and have an Administer appointed by the Court.
Whether the person is the Executor named in the Will or the Administrator appointed by the Court, their job will be to settle the debts, pay any necessary taxes and funeral expenses, and distribute the remainder of the assets that were left over according to the Will or if no Will then to the laws of Intestacy of the that State.
